Event overview

You will be trained to act as an evaluative mediator, and will be guided through a variety of practical situations. You will learn how to deal with challenges that are specific to the evaluative mediation process.

These include how to use your sector skills and experience, as well as your understanding of the matter, appropriately to:

  • Help the parties consider the merits of the various options for settlement that emerge during the negotiation
  • Help the parties understand the risks associated with taking the matter to court or arbitration through a process of robust reality testing
  • Provide your neutral evaluation as to the prospects of success in court or arbitration based on the evidence revealed to you
  • Help the parties to achieve an outcome based on wider commercial as well as narrow legal grounds


Day one – Reinforces your understanding of RICS’ approach to mediation – both facilitative and evaluative.
It involves lectures and practical role play exercises.
Day two – Focuses on the specific challenges and techniques of evaluative meditation.
Day three – Four role play practices.
Day four – Covers the practical skills involved in running an evaluative mediation role play assessment and producing a written recommendation after the course.


Requirement

1) Passed RICS mediation training Module 2 training requirements.
2) HKMAAL accredited mediators (including those who did not renew their accreditation)
3) Those who took an accredited mediation course can take this course, in addition to fulfilling all RICS requirements, must become accredited mediators in the region, before they can apply to get on the RICS President’s Panel of Evaluative Mediators. 


Speaker

Mr. Winston Siu, Winston is a mediation practioner, trainer, coach and assessor for various mediation programmes. Winston is a commercial mediator accredited by CEDR (Centre for Effective Dispute Resolution, London), general mediator accredited by Hong Kong International Arbitration Centre, Hong Kong Mediation Centre, and CEDR trained mediator assessor.

Winston was in senior management in private and public companies involved in real estate development, construction, investments, real estate brokerage, anagement consulting before he became a mediator.

Prof. Leung Hing Fung, Prof. Leung Hing Fung, FCIArb, FHKIArb, FRICS, FHKIS, Barrister-at-law, HKMAAL Accredited Mediator, is a practising mediator, arbitrator and barrister. He is an Associate Professor in the Department of Real Estate and Construction, University of Hong Kong specialising in alternative dispute resolution, land law and construction law.

Prof. Leung has participated actively in services to assist the development of mediation in Hong Kong. He was Chairman of Hong Kong Mediation Council from 2012-2014. He is a member of Mediation Accreditation Committee of HKIAC, a Lead Assessor for Stage 2 mediation assessments and a Council Member of HKMAAL in Hong Kong. Besides, he is a member of the Working Group on Evaluative Mediation and Sub-Committee on Regulatory Sub-Committee under the Steering Committee on Mediation chaired by the Secretary for Justice of HKSAR.
