Do you know that your business may get into trouble if you don't have a TCSP license before March 2018?

We’re sorry, we didn't really mean to scare you but K-Town Community wants to ask for your undivided attention to the new licensing requirements and the regime for Trust or Company Service Providers (“TCSPs”) under the Anti-Money Laundering and Counter-Terrorist Financing ordinance (Cap. 615) ("AMLO") and Companies Ordinance (Cap. 622). This might raise few questions in your mind; Who qualify as TCSPs? and why do I need to know?

TCSPs is any person whose business provides any of the following services:
a. forming companies or other bodies corporate
b. acting, or arranging for a person to act as a partner of a partnership.
c. providing a registered office, business address, correspondence or administrative address or other related services for a body corporate or partnership.
d. acting, or arranging for another person to act, as a nominee shareholder for a person other than a company whose securities are listed on a regulated market.

What & Why you should know about the new TSCP licensing regime?

The implementation of the new TCSP licensing regime aims to enhance transparency of corporate beneficial ownership by requiring companies incorporated in Hong Kong to obtain and maintain up-to-date beneficial ownership information by keeping a Significant Controllers Register.

So if you wish to continue ding trust or company services as business in Hong Kong, you are required to apply for a license from the Companies Registry and satisfy a "fit-and-proper" test before the commencement of operation of the licensing regime (1st March, 2018).
