This talk assumes that audience have a basic understanding of programme delay analysis and aims to guide the attendees through the process of the how to prepare or defend a claim for delay and EOT; outlining the obligations of the parties, establishing a baseline planned programme noting the flaws, provide detail of typical head of claim delay events, ensure the notice provisions are complied with, how to fully particularise the relevant delay events, provide a useful flowchart to guide the process for preparing and/or defending a claim for delay and EOT, with guidance as to how to ensure that the claim is credible, or as to how to challenge and rebut a claim. The talk will conclude with some key take away summary points.



Mr Clive Holloway, MCIOB MAE


Mr. Holloway is a Senior Director in the Construction Solutions practice at FTI Consulting based in Hong Kong.  He is a Charted Builder and an accomplished construction professional with over 40 years of experience globally in the construction and engineering industry and has worked on a wide variety of projects and in many sectors. His entire career has been dedicated to the field of programming, delay analysis, claims and expert work. He is very experienced in dealing with time-related issues of delay and disruption on projects in dispute.


He is a Practising Member of the Academy of Experts and has been appointed as Programme Expert Witness on many occasions and twice been cross-examined and given testimony in Arbitration. He is listed in ‘Who’s Who Legal Construction’ where Clive is described as ‘experienced practitioner, a great team player who fully understands what is required as an independent expert witness’. When appointed as Expert Advocate for Claimants and/or Defendants his involvement as a Forensic Delay Analyst, he has produced numerous time-related expert reports with respect to; risks, strengths and weaknesses of EOT delay claims in adjudication, mediation, amicable settlement, negotiation, etc.
